POLICIES

La Quinta Adobe is a 100% Pet Free | Smoke Free Property

Smoking
To preserve the comfort and health of the owners and all future guests, the casita is SMOKE FREE. Smoking is not permitted inside or surrounding the casita at any time.  Violation of this policy as revealed by smoke, ash, discarded cigarette butts or burns will result in termination of the rental agreement and surrender of all rent paid, including the cleaning deposit.   Guests will be financially responsible for cleanup or restoration required by any refuse or damage caused by unpermitted cigarettes and cigarette smoke.

Pets
Pets are not allowed on or in the property at any time.  Even the best behaved pets scratch and damage glazed tile floors, doors and furniture, and pet dander requires extra cleaning of carpets and bedding.  Guests are responsible for ensuring their own visitors do not bring pets on or in the property.  An exception is made for certified guide or service dogs. Guide or service dogs are not allowed in the swimming pool.

Deposits
In addition to rent, guests are required to pay both a cleaning deposit and a security deposit in advance of check-in-date.  The cleaning deposit is used to restore the property to the same level of cleanliness as when it was provided to guest, if necessary.   Refer to the departure checklist.  The security deposit is used to cover any damage to the property, lost keys, or other items not specifically related to cleanliness.

The deposits will be held in a non-interest bearing account. It is the obligation of the guest to surrender the rental property in good and clean condition by the time specified, except for reasonable wear and tear.

If owner determines that a guest and/or their visitors is at fault for damage to the property (not related to normal wear), the guest will be charged for any additional cost over or above the security and cleaning deposits to correct the problem(s). Owner shall be the definitive authority in apportioning fault, and cost, in such cases.

Deposit will be returned via PayPal or by regular U.S. Mail to guest as soon after a practical inspection by owner as possible, or, within 30 days following guest’s departure, less any costs to repair or replace any damage or loss to the rental property or the contents thereof.

Owner may retain the deposits for violation of the Terms and Conditions of the Rental Agreement.

Cancellation
In the event that the guest must cancel a reservation for any reason, a cancellation fee will be assessed. If the cancellation occurs more than thirty (30) days prior to the Check-In Date and the Owner is unable to re-rent the casita by the guest’s Check-In Date, the guest will be liable for fifty (50%) percent of the rental costs. If the cancellation occurs less than thirty (30) before the Check-In Date, all monies paid by guest will be forfeited if the casita is not re-rented by the Check-In Date. Owner will make all reasonable efforts to re-rent the casita by the Check-In Date.

Candles
In the heat of the desert, even with air-conditioning, candle wax will easily and quickly melt and overflow a dish or plate, staining and damaging wood, tiles, walls, and the floor.  Security Deposits and Cleaning Deposits have been applied against candle wax damage on several occasions.   For that reason, interior candles are not recommended.  Those displayed in wall sconces or lanterns around the home are designed for the heat and are decorative, only, and should not  be burned by guests.  If personal candles are desired for dining or ambiance, please use appropriate holders and extinguish immediately after each use. Store the candles in the refrigerator.

Cleaning         
Owner takes great care to assure the property is in excellent condition for every guest, using a detailed check list.  The condition of the property assures a happy and peaceful stay for all guests.    To assist guests in preparing the casita for departure, and to avoid loss of the cleaning or security deposit, as well as financial responsibility for additional cleaning or repairs required, guests should  refer to the departure check list and use it as a guide.

Definitions
For purposes of the Rental Agreement and these policies, the following definitions apply and may be used interchangeably:  Owner includes any designated agent for Owner.   Guest refers to the responsible party who submits the rental agreement, as well as all family and other occupants who share the dwelling with guest. The dwelling may be referred to as the  “casita” or “the home”, “the property”, “the rental property” or “the premises”.   The Rental Agreement refers to the agreement between owner and guest to rent the dwelling for a specific period of time.  The policies refer to both those policies contained in the electronic application to rent the dwelling and those stated on this page.

Dishes and Cookware
Dishes, tumblers, drinking glasses, cutlery, knives, gadgets, pots and pans are all provided.   There is sufficient place settings for six (6) persons.  A dishwasher is available for washing dishes and cutlery.  A microwave, coffee maker and blender is available.

Food
Please remove any perishable food you may bring with you,  prior to departure.  Some food items may remain in the cupboards and refrigerator (sugar, coffee, tea, etc.) which you are welcome to use, but we ask that you replace what ever you consume before your departure.

Fire Extinguisher
There is a fire extinguisher in the kitchen pantry.  It should not be tampered with or  removed for any purpose other than to extinguish fires.

Fireplaces
The interior wood-burning fireplace is available year round, however, it should not be used while the air-conditioner is running as the air drawn and circulated through the house will distribute smoke.   It is not suitable for cooking.   The exterior poolside chimera burns wood.  It is not suitable for cooking.  The outdoor propane grill should be used for any food prepared outside of the kitchen.

Fireworks
Fireworks are not permitted in, around, or near the premises, or in the street in front of the premises, at any time.  Guests will be financially responsible for cleanup or restoration required by any refuse or damage caused by guests or their visitors due to permitted fireworks.

Garbage
Garbage is collected weekly on Thursdays. Please wheel the bins to the curb and return the bins to the carport after pick-up.  It is the Guest’s responsibility to routinely compact trash into the receptacles and to replace the lids after each deposit, to maintain the trash area of overflow litter and debris.

Guest-Invited Visitors
Guests are fully responsible for the behavior of invited visitors ensuring they follow all house rules.

Illegal Substances
There shall be no use of any illegal substances by any guest, occupants or visitors in or on the grounds of the casita, at any time.  There shall be no consumption of alcohol by any guest, occupant or visitor under the age of 21.

Keys
If guest arrives on a date when owner is not present, a lock box on the property contains a set of house keys.  The code is provided to guest prior to arrival, when necessary. The code is changed after the departure of every guest for safety and security purposes.    Lost keys require owner to re-key all doors.  Guests who lose the house keys must surrender the security deposit to cover the expense of the locksmith visit, re keying doors, and new keys.

Laundry  
A full size washing machine and dryer are available for use by guests.  Although laundry soap and supplies may be available from time to time if left by owner or prior guests, owner does not guarantee provision of laundry supplies.  Owner is not responsible for any loss of clothing, valuables, or any damage to clothing resulting from use of the laundry equipment.   Guests are expected to clean the lint trap in the dryer.

Law Enforcement Complaints
Any complaints to law enforcement concerning the behavior of the guest, guest’s family, or visitors while occupying the casita shall, at the owner’s sole option, result in immediate termination of the rental agreement and a forfeiture of all rents and deposits paid.

Locked Areas
Any locked cupboards, closets, rooms or sheds contain owner’s personal property and maintenance equipment.  Please respect these locked closets, cabinets or rooms.

Linens
Bath towels, swimming pool towels, sheets, pillows, pillow cases and blankets for all beds are provided.  A washing machine and dryer is available to launder soiled linens.

Lost or Abandoned Property
Owner is not be responsible for items lost during a stay or left behind in the casita after departure.   In the past, guests have voluntarily left behind paperback books, magazines, food items, and dishware.    These items are considered abandoned and made available for use by future guests or donated to charity after a guest’s departure, in owner’s sole discretion.     Please double check your possessions to assure you have collected all personal items prior to your departure.    If personal property of a valuable nature is lost during your stay, please report it to owner so that a search can be made during the clean-up process.

Maintenance
The casita is inspected thoroughly by owner before every stay by a guest, to assure all appliances, heat pumps and air conditioners, lights, and pool equipment are in working order.  From time to time, maintenance may be required during a guest’s stay.    If the casita or any of the contents are damaged, not working or otherwise in need of repair or replacement, the guest must promptly notify the owner. Owner will require a reasonable amount of time to travel to La Quinta to make repairs. If the guest must vacate the premises because of damage not resulting from the guest’s acts or neglect, guest will be refunded the rent for such period of time that the guest is unable to occupy the casita, prorated on a per diem basis commencing on the date that the guest was forced to vacate and calculated to the date on which the guest was able to re-occupy the casita or the end of the rental period, whichever comes first.

Owner is not responsible for any inconvenience or interruption of the rental period or services in the casita due to weather, earthquakes, or similar events which could not be anticipated and are beyond the Owner’s control, and no refund will be given in this event.

Emergency requests for maintenance or repair should be reported to the owner immediately for handling.   Guests should promptly report all leaking faucets, leaking drain piping, leaking/running toilets, and all other defects in the casita to owner.

Guests shall not undertake any maintenance or “handy work” of any damage discovered or caused by guest, without  contacting owner.

No alterations, or additional appliances can be made/installed.

Guests shall use the equipment and appliances in the casita as they are intended. This includes, but not limited to:

a) Keeping objects/utensils, and food items/grease out of drains.

b) Not using garbage disposals as a food/garbage processor. Disposals are for incidental biodegradable items, and not meant to handle large amounts of rice, pasta, grease, meats, bones, etc.

c) Toilets are not to be used for disposal of feminine products, prophylactics, cigarette butts, cosmetics, or any garbage.

d) Windows are not to be used for dumping/throwing items outside, or for entering/exiting the casita.

Every effort will be made to promptly repair any inoperable appliance during a guest’s stay, however, no monetary refunds will be made for inoperative air conditioners, appliances or for mechanical failure.

No signs or placards shall be posted in or about the casita.   Further no wires, cables, antenna, satellite dishes, ropes, or anything else are permitted to be affixed to the casita in any way.

Modifications
The terms of the rental agreement (rates, length of stay and occupants) between owner and guest can only be changed by an agreement in writing by both parties.  However, owner reserves the right to amend, supplement or modify any or all policies at any time.  Notice to guest (via telephone, email, or written document) will be provided if the policies are modified.

Noise
The casita is located in a quiet residential neighborhood.   Guests, and their guests, shall have due regard for the peace, comfort, and enjoyment of neighbors.   Musical instruments, radios, television sets, CD players, etc., particularly poolside, shall be played only at reasonable levels AT ALL TIMES. Any undue noise or disturbances reported to the owner shall constitute grounds for termination of the tenancy.

Occupancy Policy
The recommended occupancy limitation of the casita is four (4) adults.  Children who normally sleep in a crib are not counted in the occupancy limitation.    Cribs are not provided.  The Queen Bedroom sleeps 2 adults in one bed.   The Twin Bedroom sleeps 1 adult in each of the two beds.  The Living Room has one sofa which does not fold-out.  Over-occupancy is a violation of your vacation rental agreement and will cause an expedited eviction.

Occupants
Occupants represent themselves to be an adult 21 years of age or older. In addition, all guests of occupants must be immediate family (such as siblings, children, grandchildren or great-grandchildren).  No overnight guests of guests, unless fully identified in a rental agreement, are ever permitted.

Parking
Parking for 1 car is available in a carport.  An additional car will fit behind it in the driveway.  Street parking in front of the casita is available.   Also see “Recreational Vehicles.”

Parties
No parties are permitted if the occupancy rate exceeds eight (8) adults.

Propane BBQ
Guests are welcome to use the Propane BBQ.  While there is usually propane left from each guest, owner does not guarantee provision of a full bottle propane.  After using the BBQ, burn an additional five minutes to burn off any food residue and then brush the grill clean.

Recreational Vehicles (RVs) and Powered Vehicles
RVs are never permitted to park in the driveway or in front of the property.  RVs include mobile homes, motor homes, campers, and trailers (i.e. motorcycle trailers, boat trailers, jet ski trailers).   Guests may not connect or hook up any vehicle which relies on owner’s power source or septic tank.

Residential Use Only
Guests shall not conduct any public business at the property including day care, retail sales, service work, yard sales, meetings, conferences, fundraisers or personal services.

Right of Access
The owner or any agent of owner shall have the right but not the obligation to enter into the rental property and upon the premises at all reasonable hours for the purpose of inspection or maintenance, but the owner agrees not to exercise this right in such a way as to unreasonably interfere with the quiet enjoyment of the property by guest.

Swimming Pool
The swimming pool is recommended for adults only as there is no alarm, cover or security device, and there is no fence or gate surrounding the pool.    Guests assume all risks associated with use of the swimming pool, on their own behalf and that of their visitors, if any.  A rescue hook is located in the storage shed adjacent to the swimming pool.

The swimming pool is saline based and requires no chemical maintenance.  Tools, including a hand held low-noise leaf blower for the patio, are in the locked shed, as well as pool rafts for your use.  The keys for the shed are in a bowl on the side board.  Please return the tools and DRY rafts to the shed, lock the shed, and return the keys to the bowl before you leave.

The pool light is located on the wall next to the pool pump. Turn off the pool light immediately after use.

The pool is serviced twice weekly on a random schedule (no set day). The pool maintenance team generally arrives early the morning, once per week, and let themselves in through the gate next to the carport.

Walk; don’t run in and around the swimming pool.

Minors must be accompanied by a parent or responsible person, in a swim suit, at all times including in the water, on the patios, or the hot tub.

While in the water, a parent or responsible adult must remain within arms reach of the minor at all times.

Never leave minors alone in or near the swimming pool, even for a moment.

An adult who knows CPR should actively supervise minors at all times.

Minors who are not toilet-trained and less than five years old must wear a swimsuit diaper or plastic pants and a swim suit. Cloth or disposable diapers are not acceptable.

Diving in water, back dives, somersaults, or “cannon balls” from the side of the pool or any other unsafe activities are not permitted.

The intense sun in this region will quickly overheat, and eventually destroy, flotation devices and swimming pool toys if these items are left in the pool for extended periods of time.   All flotation devices and toys should be removed from the pool each evening and stored in the supply shed when dry.

No drinking glasses, wine bottles, or other breakable dishes are allowed in or around the swimming pool.

Plastic drinking tumblers are available for poolside refreshments.

Paper plates are recommended for food and snacks.

Towels and wet suits are not to be left on the ground or draped from wooden or leather furniture.  Please use the provided hooks on the wall or hang to dry on metal lounge beds.

For guest comfort, please cover lounges or chairs with towels when using suntan lotions, oils or ointments.

Telephones
Telephone service is not provided in the casita.  Please bring a cell phone and charging devices.   To contact owner by telephone, use the telephone number provided to you at time of check-in.

Transfers and Sublets
Guests may not transfer or assign this Rental Agreement or sublet the rental property under any circumstances.

WiFi
Free Wireless Internet service is available to guests.  No computers or printers are available.  Please bring a laptop for your use.  The nearest business center for guests who need to rent a computer or print boarding passes is the Fed Ex Office on Hwy 111.  760-564-4016.

Windows
Window coverings are supplied by owner for every accessible window, with the exception of roof line light source windows.    No foil, or any other material, is to be taped on the windows or hung on the rods.

Breach of Rental Agreement or Policies
Owner and Guest agree that every condition, covenant, and provision of the Rental Agreement and Policies is/are material. A breach of any condition, covenant, or provision of the rental agreement or rental policies by guest will constitute a material breach. For any material breach by guest, owner may provide guest with a written notice which describes the breach and demands that guest cure the default within 48 hours. If guest does not cure the default within 48 hours, or if a cure is not possible, the rental agreement will be terminated.

In the event of breach by guest, owner reserves all rights and remedies conferred under the laws of the State of California, including the right to terminate the rental agreement, the right to immediate possession of the premises, the right to all deposits, and the right to all damages.

Additionally, the parties agree that the following provisions apply to a breach of this rental agreement by guest:

If guest breaches this lease and abandons the property before the end of the term, or if owner terminates guest’s right to possession because of guest’s breach of this lease, owner may recover from guest:

(a)    The worth at the time of award of the unpaid rent that had been earned at the time of termination;
(b)    The worth at the time of the award of the amount by which the unpaid rent that would have been earned after termination until the time of award exceeds the amount of the rental loss that guest proves could have been reasonably avoided;
(c)    The worth at the time of award of the amount by which the unpaid rent for the balance of the rental period after the time of award exceeds the amount of the rental loss for the period that guest proves could be reasonably avoided; and
(d)    Any other amount necessary to compensate owner for all the detriment proximately caused by guest’s failure to perform guest’s obligations under this rental agreement, or that in the ordinary course of things would be likely to result from that failure.

Liability Exclusion
GUEST’S SOLE REMEDY FOR OWNER’S FAILURE TO MAKE THE RENTAL PROPERTY AVAILABLE FOR THE RENTAL PERIOD IS A REFUND OF THE FEES PAID. OWNER SHALL NOT BE LIABLE FOR LOSS, INJURY OR DAMAGE TO ANY PERSONS OR PROPERTY. GUEST AND ALL OCCUPANTS AGREE TO INDEMNIFY AND HOLD HARMLESS THE OWNER FROM ANY LIABILITY AND COSTS ARISING FROM INJURY TO ANY OCCUPANT, THEIR CHILDREN AND VISITORS, UNLESS IT IS EXPRESSLY DUE TO THE ACT OF OWNER AS DETERMINED BY A JUDICIAL TRIBUNAL
